2. Content of summary information page
Firstly, the thesis proposes a theoretical framework as a tool to think about the accountability of the head of state administrative agency (SAA) through providing the concept about the head of SAA; analyzes the characteristics of legal position of the head of SAA; interprets the concept of the accountability of the head of SAA with its own approach to the connotation that the term “accountability” should be unified and compatible among three elements of obligation, authority and taking accountability; at the same time, forms a system of theoretical content about the scope, content, type of accountability of the head of SAA as well as factors affecting the performing the accountability of the head of SAA.
Secondly, the thesis makes an assessment of the actual taking accountability of the head of SAA in Vietnam today in terms of regulation and the performing of the accountability of the head of SAA which focuses on three elements of obligation and authority and taking accountability. The thesis points out the subjective and objective reasons causing the limitations of the head of SAA which mainly come from the regulation and capacity and moral of the head of SAA.
Thirdly, on the basis of theoretical and practical studies, the thesis proposes a system of solutions to enhance the accountability of the head of SAA in Vietnam today. The solutions to the legal regulations of the accountability of the head of SAA include: (i) Ensure the “Zheng Ming” of the head of SAA; (ii) The accountability of the head should be prescribed consistently and clearly; (iii) The accountability of the head of SAA must be defined in a unification and compatibility among the elements of obligation, authority and taking accountability. The solutions for the performing the legal provisions about the accountability of the head of SAA include: (i) Advocate and educate about the accountability of the head of SAA; (ii) Renew of the assessment activities for the performing accountability of the head of SAA; (iii) Improve the effectiveness of supervision of the implementation of the accountability of the head of SAA; (iv) Public and transparent enforcement activities of the head of SAA; (v) Timely and strictly handle the violations of the accountability of the head of SAA.
